Agreement

These Terms of Use ("Terms") form a binding agreement between you and Aquarion Labs ("we", "us") and govern your access to and use of the Caldera Spiritual Journal application (the "Service"). By installing, signing in, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Service.

Eligibility

You must be at least 13 years old (or the minimum age required to use Apple ID services in your country, whichever is higher) to use Caldera Spiritual Journal. If you are under the age of legal majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and accepted these Terms on your behalf. The Service is intended for personal, non-commercial use only.

The Service

Caldera Spiritual Journal is a private, on-device diary built around a morning intention, an evening review, and the Yamas & Niyamas, with reflections produced on your device. The journal itself is free and ad-supported; a single one-time in-app purchase (the "unlock") reveals the insight graphs and removes ads. The content, features, design, price, and availability of the Service may change at any time without prior notice. We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.

Account & Authentication

You can use the journal without an account. If you choose to sign in with Sign in with Apple — for example, to restore your one-time unlock — you are responsible for maintaining the security of your Apple ID and for activity under your account, and for promptly notifying us of any unauthorized use. We may suspend or terminate accounts that we believe, in our sole discretion, have violated these Terms or applicable law.

Not Professional Advice

Caldera Spiritual Journal is a tool for personal reflection and journaling. It is not therapy and not a medical device, and its prompts and on-device reflections are not medical, psychological, legal, financial, or other professional advice, and must not be relied upon as a substitute for care from a qualified professional. If you are struggling with your mental health or experiencing a crisis, please contact a qualified professional or your local emergency services.

Your Journal & Your Responsibility

Your entries are yours. They are stored, encrypted, on your device, and we do not receive, hold, or back up any copy of them. Because of this, you are responsible for your own device backups. Uninstalling the app, resetting or losing your device, or deleting entries will permanently remove your journal, and we cannot recover it for you. If you rely on an encrypted device backup (for example iCloud or Finder/iTunes backup), your journal is only recoverable to the extent that backup includes app data and you can restore it.

One-Time Purchase & Refunds

The unlock is a one-time in-app purchase processed by Apple via StoreKit — not a subscription. It is tied to your Apple ID and can be restored on your devices. Apple is the merchant of record for all purchases. Refund requests must be submitted directly to Apple through your purchase history or at https://reportaproblem.apple.com. We are unable to issue refunds outside of Apple's process.

Acceptable Use

You agree not to: (a) bypass or tamper with the purchase or unlock flow; (b) reverse engineer, decompile, or attempt to extract source code from the Service except to the extent permitted by law; (c) attempt to access another user's account or data; (d) interfere with or disrupt the integrity or performance of the Service; (e) use automated tools, bots, or scrapers; (f) introduce viruses, malware, or other harmful code; (g) use the Service in violation of any applicable law or to facilitate illegal activity; or (h) infringe others' rights.

Intellectual Property

The Service, including all text, graphics, logos, icons, designs, software, and curated prompts and content (collectively, the "Content"), is owned by Aquarion Labs or its licensors and is protected by copyright, trademark, and other intellectual property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service and Content for your personal, non-commercial use only. You may not copy, reproduce, modify, publish, distribute, sell, or create derivative works from any part of the Service without our prior written consent. Your own journal entries are not our Content and remain entirely yours.

Advertising

The free version of Caldera Spiritual Journal is supported by advertising delivered through Google Mobile Ads. Whether ads are personalized depends on your App Tracking Transparency choice and your consent collected via Google's User Messaging Platform. The one-time unlock removes ads.

Third-Party Services

The Service integrates with Apple (Sign in with Apple, StoreKit, Keychain, LocalAuthentication, and the on-device NaturalLanguage framework) and Google (Mobile Ads and User Messaging Platform, in the free version). Your use of those features is also governed by the respective providers' terms and privacy policies.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE ON-DEVICE REFLECTIONS OR ANY OTHER OUTPUT ARE COMPLETE, ACCURATE, OR FIT FOR ANY PARTICULAR PURPOSE, AND WE DO NOT WARRANT AGAINST LOSS OF ON-DEVICE DATA.

Limitation of Liability

To the maximum extent permitted by law, in no event will Aquarion Labs, its affiliates, or its licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data (including loss of journal entries stored on your device), goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service. Our total cumulative liability for any claim relating to the Service will not exceed the amount you paid us, if any, in the twelve (12) months preceding the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Aquarion Labs from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any rights of another party.

Termination

You may stop using the Service at any time and delete your data by deleting entries or uninstalling the app. We may suspend or terminate your access to all or part of the Service at any time, with or without notice, if we believe you have violated these Terms or if doing so is necessary to comply with law or protect users. Sections that by their nature should survive termination — including Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law — will survive.

Changes to These Terms

We may revise these Terms at any time. We may also change, suspend, or discontinue features, content, price, or availability. The "Last updated" date reflects the latest revision. Material changes will be communicated within the app before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

Governing Law & Disputes

These Terms are governed by the laws of the jurisdiction in which Aquarion Labs is established, without regard to its conflict of law principles. Any dispute will first be addressed informally by contacting us. If unresolved, disputes will be resolved exclusively in the competent courts of that jurisdiction, except where applicable law grants you the right to bring a claim in your local courts.

Apple-Specific Terms

You acknowledge that these Terms are concluded between you and Aquarion Labs only, not with Apple, and that Apple is not responsible for the Service or its content. Apple has no obligation to furnish maintenance or support and will not be liable for any product warranty, claims, intellectual property infringement, or consumer protection law violations relating to the Service. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

All purchases are processed through Apple's App Store. By making a purchase, you also agree to Apple's standard Licensed Application End User License Agreement, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.
